TOS violation (spam)?

Hi,
I recently received an email from "abuse" in which he informs me that an email account has been suspended the SMTP service because of spam, the email account is my brother and I'm 1000% sure that is not being used to "play" with this, on the other hand, the copy you sent me and that is who was allegedly doing that belongs to someone in Taiwan (or at least says what IP) (and my brother is in Spain), just in case the first thing I did was change the password, but since most of me I can not do, what would be the next step for them to return to you enable SMTP account?, thanks.
