Domain transfer question

I utilize Jodohost as my main domain registrar. However, I noticed that some other registrars do not require you to have the transfer key before putting in a transfer request. It is the case where some old registrars aren’t giving us the transfer key but will accept the transfer request once we put it in. We have to utilize another registrar to put in the transfer request without the key.

My question: Why is it that I am required to have the transfer key before putting in the transfer request and is there a way to bypass that for the few “problem domain registrars” that are being difficult and non-helpful to their soon-to-be former customers?

Transfer Rules are govern by ICANN. Please see point 5 - ICANN | Archives | Policy on Transfer of Registrations between Registrars

But that’s just stating that the transfer key has to be provided within 5 days of the transfer request, not that it must be there before the request is put in. Again, we deal with multiple other registrars that we can put in the transfer request, and then we get an email that has the transfer key and a link to authorize the request.
